Terms and Conditions

Participation in the competition organized by Grüezi bag GmbH, hereinafter referred to as the operator or organizer, is free of charge and is governed exclusively by these terms and conditions.

Expiry of the raffle

The competition runs for three weeks from the magazine's initial publication date. Users have the opportunity to participate within this period.

Participation

To participate in the competition, you must truthfully complete and submit the displayed entry form. Only one entry per participant will be accepted into the competition per day. Using multiple email addresses to increase your chances of winning is strictly prohibited.

Participation in the competition is free.

eligible

Eligible to participate are natural persons who have reached the age of 18. Participation is not restricted to customers of the organizer and is not dependent on the purchase of any goods or services.

Should a participant be restricted in his business ability, it requires the consent of his legal representative.

• Not eligible to participate in the competition are all persons and employees of the operator involved in the conception and implementation of the raffle and their family members. In addition, the operator reserves the right, at its discretion, to exclude persons from participation if justified reasons exist, for example

• (a) in the case of manipulation in connection with access to or the performance of the Sweepstakes, (b) in the event of a breach of these Terms of Participation, (c) in the event of unfairness or (d) in the case of false or misleading claims in connection with participation in the Sweepstakes.
• Participation on behalf of third parties is prohibited; participants may only participate on their own behalf. Violation of this rule would also result in disqualification from the competition.

In these cases, winnings may also be subsequently revoked and reclaimed.

Implementation and processing

The winners will be determined after the competition deadline in a random drawing among all participants (subject to the terms and conditions). If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the drawing.

The winners of the raffle will be informed promptly via a separate e-mail about the prize.

The prize will be awarded exclusively to the winner or the legal guardian of the minor winner. Exchange, self-collection, and cash payment of the prize are not possible. Furthermore, prize claims cannot be transferred to third parties. 

Any costs incurred for the delivery of the profits shall be borne by the operator. Any additional costs associated with making use of the prize shall be borne by the winner. For a possible taxation of the profit the winner is responsible.

Any complaints must be submitted in writing to Grüezi bag GmbH and Top Mountain Tours GmbH within 14 days of becoming aware of the reason, stating the competition. Complaints submitted by telephone or after the deadline cannot be processed.

If the notified winners do not respond to the notification of their win within 14 days of the announcement, their right to the prize will expire and a new winner will be drawn at random.

The winner will receive the prize stated in the competition.

Termination of the raffle

Grüezi bag GmbH reserves the right to cancel or terminate the competition at any time without prior notice, for example, if proper conduct of the competition cannot be guaranteed for technical reasons (e.g., viruses in the computer system, tampering with, or errors in the hardware and/or software) or for legal reasons.

Liability

In particular, Grüezi bag GmbH is not liable for damages that may arise due to errors, delays or interruptions in transmission, malfunctions of technical systems and services, incorrect content, loss or deletion of data, viruses or in any other way when participating in competitions, unless such damages are caused intentionally or through gross negligence by Grüezi bag GmbH (its bodies, employees or vicarious agents).

Privacy Policy

For the participation in the raffle the indication of personal data is necessary. The participant assures that the information provided by him about the person, in particular first, last name and email address are true and correct.

The organizer points out that all personal data of the participant will neither be passed on to third parties nor made available to them for use without consent.

In the event of a win, the winner agrees to the publication of their name and place of residence in the promotional media used by the organizer. This includes the announcement of the winner on the organizer's website and its social media platforms.

The participant can revoke his/her declared consent at any time. The revocation must be sent in writing to the contact details of the organizer given in the imprint area of ​​the website. After revocation of the consent, the collected and stored personal data of the participant will be deleted immediately.

 Otherwise, the data protection regulations of the sole proprietorship Grüezi bag GmbH apply.

Applicable Law

Questions or complaints in connection with the competition are to be directed to the operator. Contact options can be found in the imprint area of ​​the website.

The operator's competition is subject exclusively to the law of the Federal Republic of Germany. The judges' decision is final.

Severability

 Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining Terms and Conditions shall remain unaffected. In place of the invalid provision, the legally permissible provision shall apply that most closely approximates the economic meaning and purpose expressed in the invalid provision. The same applies if there is a gap in these Terms and Conditions.

These terms and conditions of participation can be changed at any time by Grüezi bag GmbH without separate notification.
